11. LIABILITY LIMITATION
Within the legally admissible limits, CRATONI - for the company itself and its suppliers -
excludes any liability - no matter whether for contract or damages (including negligence) - for
accidental, subsequential, indirect or concrete damage or fines of any kind or for the loss of
income or profits, business losses, loss of information or data or other financial losses resulting
from the sale, installation, maintenance, use, performance or malfunctions of their products or
related to them even if CRATONI or the dealer authorised by CRATONI has been informed about
the possibility of such damage and limits the liability of the company at their own discretion
to the repair, replacement or compensation of the purchase price. This exclusion of liability
for damages shall remain unaffected if any one of the remedies provided for therein does not
satisfy its essential purpose. The complete liability of CRATONI or their sales representatives for
damages shall in no case exceed the price paid for the purchaser for the product.
12. LIABILITY EXCLUSION
In addition to damage resulting from the use of the product, CRATONI shall not be liable for
damage to the product resulting from the following.
• Improper use of the product or its use for other purposes than the intended purposes.
• Damage to the product due to non-compliance with the product manual by the user.
• Damage to the product as it was left unattended or due to any other accident.
• Damage to the product as the user used other parts or a different software than the one(s)
provided by the manufacturer.
• Damage to the product as the user disassembled, repaired or modified it in a way not described in
the product manual.
• Damage caused by third parties
• Damage to the product by force majeure (including fire, flooding, earthquakes, storm, hurricanes
or other natural disasters).
• Use-related damage to the product surface.
